IMEXA maintains a structured and impartial disciplinary process to address allegations of misconduct and ensure compliance with its Professional Standards and Code of Ethics.
All matters are handled in accordance with principles of fairness, due process, confidentiality, and accountability. The process is designed to protect both the public and the rights of the member involved.
Complaint Submission
All disciplinary matters begin with the formal submission of a complaint through IMEXA’s designated reporting channels.
Complaints must:
- Be submitted in good faith
- Include sufficient detail to allow for assessment
- Be supported by relevant information or evidence where available
Upon receipt, IMEXA will acknowledge the complaint and conduct an initial review to determine whether the matter falls within its jurisdiction.
Investigation
Where a complaint is deemed valid for further review, IMEXA will initiate a formal investigation.
This may include:
- Review of submitted evidence and documentation
- Collection of additional information
- Engagement with relevant parties
- Consultation with subject-matter or legal experts where necessary
Investigations are conducted objectively and without bias, with all findings based on available evidence.
Member Response
The member who is the subject of the complaint will be:
- Notified of the allegations
- Provided with relevant details of the complaint
- Given a reasonable opportunity to respond
The member may submit:
- A written response
- Supporting evidence or clarification
- Any relevant contextual information
IMEXA ensures that all members are afforded a fair opportunity to be heard.
Decision
Following the investigation, a designated review panel or committee will:
- Evaluate all available evidence
- Consider the member’s response
- Determine whether a breach of standards or ethics has occurred
Decisions are made on a balance of probabilities and are aligned with IMEXA’s Professional Standards and Code of Ethics.
Where a breach is identified, appropriate sanctions may be applied in accordance with IMEXA’s disciplinary framework.
Appeals
Members have the right to appeal a disciplinary decision within a specified timeframe.
Appeals must:
- Be submitted in writing
- Clearly state the grounds for appeal
- Include any additional supporting information
Appeals are reviewed independently, and the outcome may:
- Uphold the original decision
- Modify the decision or sanction
- Overturn the decision where justified
The decision following an appeal is considered final within IMEXA’s governance framework.
Principles of the Disciplinary Process
All disciplinary proceedings are guided by the following principles:
- Fair and impartial assessment
- Confidential handling of information
- Evidence-based decision-making
- Respect for the rights of all parties
- Protection of public interest and professional integrity
